Please read these terms carefully before using the OVCC platform. They outline the rules, responsibilities, and rights for all users, including learners, tutors, and visitors.

1. Acceptance of Terms
By accessing or using the OVCC platform — whether as a learner, tutor, visitor, or administrator — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not use our services. These terms constitute a binding agreement between you and Online Varsity College Connect (OVCC).
2. User Accounts
You must be at least 18 years of age to create an account independently. Learners under 18 may use the platform with parent or guardian consent and oversight.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate, current, and complete information during registration and keep your account details up to date.
OVCC is not liable for any loss or damage arising from unauthorised use of your account. Notify us immediately at info@ovccapp.com if you suspect unauthorised access.
OVCC reserves the right to suspend or terminate accounts that provide false information or violate these terms.
3. Educational Content & Intellectual Property
All content on the OVCC platform — including course materials, lessons, assessments, tutor profiles, and platform design — is the intellectual property of OVCC or its licensed contributors.
Unauthorised reproduction, redistribution, or commercial use of platform content is strictly prohibited.
You may not record, screenshot, or copy session content for distribution without the express written consent of OVCC and the relevant tutor.
Tutors retain ownership of original teaching materials they create but grant OVCC a non-exclusive licence to display such content on the platform during their active engagement.
Content submitted through the platform (e.g., written bios, tutor profiles) may be used by OVCC for platform operations and marketing with appropriate attribution.
4. User Conduct
All users of the OVCC platform are expected to maintain a respectful and professional environment. The following conduct is prohibited:
Posting, sharing, or transmitting offensive, harmful, abusive, defamatory, discriminatory, or illegal content.
Harassment, bullying, intimidation, or inappropriate contact directed at learners, tutors, guardians, or staff.
Academic dishonesty, including cheating, plagiarism, impersonation during assessments, or misrepresentation of qualifications.
Attempting to gain unauthorised access to accounts, systems, or data.
Using the platform for commercial solicitation, spam, or any purpose other than legitimate educational use.
Providing false or misleading information in any part of your profile, application, or communications.
5. Tutor Obligations & Standards
Tutors on the OVCC platform agree to the following obligations as a condition of their approval and continued engagement:
Application & Verification
You must submit accurate identity, qualification, and reference information as part of the onboarding process.
Submission of fraudulent documents or misrepresentation of qualifications will result in immediate disqualification and may be reported to relevant authorities.
OVCC reserves the right to verify all submitted information, including contacting provided references.
Service Delivery
Tutors must deliver sessions as scheduled and communicate promptly in the event of a cancellation or delay.
Sessions must be conducted in a professional, safe, and appropriate environment free from distractions.
Tutors must not conduct personal or financial transactions with learners outside the OVCC platform.
Tutors are responsible for the accuracy and quality of the educational content they deliver.
Safeguarding
Tutors working with minors (learners under 18) are required to uphold safeguarding standards and professional boundaries at all times.
Any concerns relating to the welfare of a minor must be reported to OVCC immediately.
Tutors must not request personal contact information from learners or guardians outside of the platform.
6. Payment & Compensation
OVCC is currently in its pilot phase. Specific payment structures for learners and tutor compensation will be communicated separately as the platform grows.
Where fees apply, payment terms, refund eligibility, and cancellation policies will be clearly stated at the point of purchase or in a separate Tutor Services Agreement.
OVCC reserves the right to withhold or reverse payment where there is evidence of fraudulent activity, misrepresentation, or breach of these terms.
Tutors must not charge learners directly for sessions facilitated through the OVCC platform.
7. Service Availability
OVCC aims to provide continuous and reliable access to the platform but cannot guarantee uninterrupted service. Scheduled maintenance, updates, or unforeseen technical issues may occasionally affect availability. We will endeavour to communicate planned downtime in advance. OVCC is not liable for any loss or inconvenience resulting from temporary service interruptions.
8. Limitation of Liability
To the maximum extent permitted by applicable South African law, OVCC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of data, loss of income, or harm resulting from reliance on educational content. OVCC does not guarantee specific academic or professional outcomes from use of the platform.
9. Independent Contractor Status
Tutors on the OVCC platform operate as independent service providers, not employees or agents of OVCC. Nothing in these terms creates an employment relationship, partnership, or joint venture between OVCC and any tutor. Tutors are responsible for their own tax obligations and compliance with applicable South African labour and tax law.
10. Suspension & Termination
OVCC reserves the right to suspend or permanently terminate access to the platform in the following circumstances:
Breach of these Terms of Service or our Privacy Policy.
Provision of false, misleading, or fraudulent information.
Conduct that harms, endangers, or harasses other users.
Failure to meet the professional standards required of tutors.
Legal or regulatory requirement to do so.
Where possible and where no urgent safety concern exists, OVCC will notify users of the reason for suspension and provide an opportunity to respond.
11. Governing Law & Disputes
These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of the platform will be subject to the exclusive jurisdiction of the South African courts. OVCC encourages resolution of disputes through direct communication in the first instance by contacting us at info@ovccapp.com.
12. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify registered users by email and update the “Last updated” date at the top of this page. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
